Previously, Trump’s administration introduced stringent rules that drove up H-1B visa denial rates and made the application process more complex, with the goal of limiting foreign workers in high-skilled positions. In 2020, a rule change also raised minimum salary requirements for H-1B holders, increasing costs for employers and decreasing the appeal of hiring foreign talent.
Biden’s recent “Modernizing H-1B Requirements” rule, if not finalized soon, may also be reworked by Trump officials to impose stricter guidelines. Proposed changes include limiting eligible specialty occupations to degrees in directly related fields, potentially excluding many applicants.
Trump’s approach to high-skilled immigration sharply contrasts with the views of some Silicon Valley supporters, like Elon Musk, who advocate for policies that attract tech talent. This difference could lead to tension within Trump’s circle, as restrictive measures may challenge U.S. tech companies’ efforts to retain skilled international workers.
